One of the local marijuana business owners is selling his marijuana grow farm, which includes his manufacturing and cultivation licenses. There’s a few issues here:
- According to the cannabis ordinance for Butte County, cannabis permits can not be sold, leased, or transferred.
- If the new owner re-applied for permits to operate, they sure could, however due to the grandfathering in of extra grow farms after the ordinance was amended to allowing only 5 grow farms in the county, then that would also be a violation of the county ordinance. Meaning that if this business shuts down, it can not start back up again or have a new one take its place.
- Therefore, technically, if this business is sold, it’s dead in the water to *legally* operate.
What to expect? Well, our county commission and State’s Attorney have done some pretty good dog and pony shows to try to convince the public that their weasel-y ways of saying these businesses are legal and within the county ordinance requirements. So, we expect another show with this one and will have our popcorn ready. But this time, before the song and dance, everyone now knows ahead of time what the law states. Now all we get to do is sit back and watch them dance around it.
